Terms of Use for Wolfeye Remote Screen

These Terms of Use (“Terms” or “Terms of Service”) govern your use of the Wolfeye Remote Screen software, including related websites, dashboards and services (collectively, “Wolfeye”).

Please read these Terms carefully before installing or using Wolfeye.

Important: Nothing in these Terms constitutes legal advice. The lawful use of monitoring software depends on the applicable laws in your jurisdiction (e.g. data protection and employment law). You are solely responsible for obtaining legal advice before using Wolfeye.

1. Parties & Scope

These Terms apply between you as customer/user (“Customer”, “you”) and

(hereinafter “Wolfeye”, “we”, “us”).

These Terms apply to all uses of Wolfeye, in particular:

  • Downloading, installing and using the Wolfeye software
  • Using the web dashboard and screenshot history
  • Using our websites, demo environments and trial versions.

2. Purpose of Wolfeye & Permitted Use

Wolfeye is software for monitoring screen activity on devices under your control (e.g. company PCs, your own devices).

Permitted purposes may include, for example:

  • IT support and troubleshooting (remote support, incident analysis)
  • Information security (e.g. detecting suspicious activities)
  • Productivity and process analysis within companies, where legally permitted
  • Audit and compliance documentation under applicable laws.

You may only use Wolfeye where you have a sufficient legal basis (e.g. consent, works council agreement, statutory permission) and have fulfilled all required information obligations.

3. Prohibited & Unlawful Use

Using Wolfeye is strictly prohibited where such use would violate applicable law. Prohibited purposes include, in particular:

  • covert surveillance of individuals where this is not permitted under applicable employment, criminal or data protection law
  • monitoring devices you do not own or control, or without sufficient authorization
  • using Wolfeye for illegal purposes (e.g. unlawful data interception, cyberstalking)
  • use contrary to employment law, collective agreements, internal policies or court/authority orders.

You are solely responsible for ensuring that your use of Wolfeye is lawful in your country and in your specific scenario. We do not monitor how you use the software and are not obliged to warn you about potential legal violations.

4. Customer Responsibility (Data Protection & Employment Law)

When Wolfeye is used in a business context (e.g. monitoring employee PCs), you as the customer/employer or IT provider are typically the data controller.

This means in particular that you:

  • ensure there is a suitable legal basis for monitoring (e.g. consent, works council agreement, statutory permission)
  • inform affected individuals (e.g. employees) transparently about the nature, purpose and scope of monitoring
  • comply with any national specifics (e.g. works council co-determination in Germany)
  • enter into a data processing agreement (DPA) with us where required, if we store monitoring data on your behalf.

We cannot guarantee that your specific use of Wolfeye is lawful. In case of doubt, please consult a lawyer or data protection officer.

5. License, Trial & Usage Rights

The following principles apply:

  • You receive a simple, non-exclusive, non-transferable license to use the software for the number of devices and term you have purchased.
  • During the trial period (e.g. 14 days), you may only use Wolfeye for testing and evaluation.
  • Reverse engineering, decompiling, reselling, renting out or unauthorized distribution of the software is not permitted, as far as legally allowed.

6. Availability & Changes to the Service

We strive to keep Wolfeye technically stable and available, but we cannot guarantee uninterrupted availability.

We may modify features, pricing and technical details of Wolfeye where reasonably required for further development. Material changes affecting existing customers will generally be announced in advance in an appropriate way.

7. Disclaimer & Limitation of Liability

Wolfeye is developed and provided according to the current state of the art. Nevertheless, we cannot completely rule out errors, outages or security issues.

To the extent permitted by law, the following applies:

  • We are liable only for intent and gross negligence and for damages resulting from injury to life, body or health.
  • In cases of slight negligence, we are liable only for breaches of essential contractual duties and limited to the typical foreseeable damage.
  • We are not liable for any damage resulting from your unlawful or non-compliant use of Wolfeye.

Your mandatory statutory rights remain unaffected.

8. Intellectual Property

Wolfeye, including source code, design, logos and trademarks, is protected by intellectual property law.

You do not acquire any ownership rights in Wolfeye under these Terms, but only the usage rights described in section 5.

9. Term & Termination

The license term is defined during the order process (e.g. via Digistore24) and may automatically renew if contractually agreed.

We may terminate or suspend your access to Wolfeye for good cause, in particular if:

  • you materially breach these Terms (e.g. through unlawful use), or
  • we are required to do so by law, court order or competent authority.

Upon termination of your license, you must stop using the software and remove any installations.

10. Changes to These Terms

We may adapt these Terms where this is necessary for objective reasons (e.g. changes in law, expansion of features).

For material changes, we will inform existing customers in an appropriate way. If you do not agree with the changes, you may stop using Wolfeye; any remaining claims are governed by the applicable contract law.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.

If you are a business, a legal entity under public law or a special fund under public law, the courts of Frankfurt am Main, Germany shall have exclusive jurisdiction.
